10) PRIVACY POLICY

10.1) PRIVACY OF COMMUNICATIONS

Member acknowledges and agrees that EC Data Systems neither endorses the contents of any communications to or from any Members' account, nor assumes responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom, or any crime facilitated thereby.

10.2) CALL RECORD LOGGING

Call records of all transmissions made using Member's account are routinely logged by EC Data Systems. These logs may be used for billing purposes and in the limited cases of third-party complaints regarding Member's use of services, EC Data Systems' suspicion of activities by Member that may constitute violation of Agreement, and/or any legal or regulatory requirement for EC Data Systems to produce such information. In the event that EC Data Systems makes use of Member's transmission logs for any purpose, EC Data Systems will provide Member with as much notice and information as is practical regarding the nature of EC Data Systems' use of Member's transmission logs. Notwithstanding the forgoing, EC Data Systems shall not be liable for the content or destination of Member's transmissions nor shall EC Data Systems be under any obligation to routinely review transmission logs.

10.3) USE OF PERSONALLY IDENTIFIABLE INFORMATION

EC Data Systems collects certain personally identifiable information from Member in the course of providing FAXAGE Services. This information includes name, address, phone number, email address and billing information. It is EC Data Systems' intent to hold this information in confidence and to utilize it only for the purposes of providing the FAXAGE Services and any routine communication or notification that may be made to Member from time to time. EC Data Systems does not sell, rent or otherwise allow third parties to access this information for marketing purposes. EC Data Systems will make commercially reasonable efforts to ensure the security of all personally identifiable information from unauthorized disclosure. The forgoing notwithstanding, EC Data Systems makes no warranty, express or implied, that the FAXAGE system will be free from security breaches that could lead to disclosure of personally identifiable information.

10.4) CONSENT TO RECEIVE OPTIONAL TEXT MESSAGING

Should member configure multi-factor (also known as 2FA) authentication, Member consents to receive verification code messages from EC Data Systems. Message and data rates may apply.

10.5) COLLECTION OF PERSONAL DATA

We may collect or obtain Personal Data about you when you visit our website for analytics, personalization and marketing purposes. We may also create Personal Data about you, such as details of your utilization of and payment for our Services, including as described in Section 10.3) USE OF PERSONALLY IDENTIFIABLE INFOMATION above.

10.6) PROCESSING OF PERSONAL DATA

We may process data relating to our website including: device type, operating system, browser type, browser settings, IP address, language settings, dates and times of connecting to our website, usage statistics, and other technical communications information (some of which may constitute Personal Data) for purposes of analytics and marketing.

We may process records of your interactions with our online advertising and content, records of advertising and content displayed on pages or App screens displayed to you, and any interaction you may have had with such content or advertising.

10.7) LAWFUL BASIS FOR PROCESSING PERSONAL DATA

In processing any Personal Data, we may rely on one or more of the following bases for doing so, as applicable to the circumstances:

Consent: We may process your Personal Data where we have obtained your prior consent to the Processing. This relates only to processing that is voluntary and not any necessary processing that is required for functionality of Services delivered to you
Contractual necessity: We may process your Personal Data where the processing is necessary in connection with any contract or service agreement that you may enter into with us
Compliance with applicable law: We may process your Personal Data where the processing is required by applicable law
Legitimate interests: We may process your Personal Data where we have a legitimate interest in processing for the purpose of managing, operating or promoting our business, and that legitimate interest is not overridden by your interests, fundamental rights or freedoms

10.8) DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

We may disclose your Personal Data to third parties for the purposes of:

Legal and regulatory authorities, upon request, or for the purposes of reporting any actual or suspected breach of law or regulation
Outside professional advisors (auditors, legal, accounting) subject to contractual confidentiality requirements
Any relevant party, court or law enforcement agency, to the extent necessary for the establishment, exercise or defense of legal rights
Any relevant third party acquirer(s), in the event that we sell or transfer all or any relevant portion of our business or assets
Any relevant third party provider, where our website uses third party advertising, plugins or content. If you choose to interact with such advertising, plugins or content, your Personal Data may be shared with the relevant third party provider

10.9) DATA ACCURACY

We take reasonable steps to ensure that your Personal Data are kept accurate and up-to-date and are erased or rectified if we become aware of inaccuracies. We will update any of your Personal Data that you inform us is inaccurate.

We take reasonable steps to ensure that your Personal Data the we process is limited to the Personal Data reasonably necessary in connection with the purposes spelled out in this Privacy Policy or as required to provide you with Services.

10.11) DATA RETENTION

We will retain copies of your Personal Data only for as long as necessary in connection with the purposes of this policy and for providing services to you, unless applicable law requires a longer retention period. We may retain your Personal Data for the duration of any period necessary to establish, exercise or defend any legal rights, and for purposes of being able to provide an accurate accounting of historical payment information.

10.12) COOKIES AND SIMILAR TECHNOLOGIES (COOKIE POLICY)

We use the following types of cookies, each of which is noted below as to whether they are opt-in or required as necessary to functionality. Where the type is 'opt-in' such cookies are not set or processed unless you affirmatively click the 'Accept' button or similar on our Cookie notice, available on each page on our site, prior to these cookies being set or processed.

10.13) CALIFORNIA CONSUMER PRIVACT ACT ADDENDUM

In accordance with the California Consumer Privacy Act, if you are a consumer residing in California the following additional terms apply to you.

(1) Right to Know About Information Collected, Disclosed or Sold

You have the right to request that we disclose what personal information we collect, use, disclose, and sell. To submit a verifiable request, please email privacy@faxage.com

If you have an account with us, we will verify the request by confirming the email address used to make the request is the same as the email address on file for the account. If you do not have an account with us, we will verify the request by sending an email to the email address used to make the request.

The categories of California consumers’ personal information we may collect are listed above.

We use the data in accordance with the preceding sections.

We confirm we have not sold any personal information to third parties for a business or commercial purpose in the preceding 12 months. We confirm we do not sell personal information of minors under 16 years of age without authorization. We may disclose personal information as specified above.

(2) Right to Request Deletion of Personal Information

You have the right to request deletion of Personal Information collected or maintained by us. To do so, please submit a request by email to privacy@faxage.com

If you are a current or former customer submitting a request by web form or email, please provide sufficient information to identify your account, including your email address on file with us. You may be asked to verify your identity by responding to us with the email address on file for the account.

If you are not a current or former customer, we may ask for proof of identity sufficient to show you are the same consumer about whom we have collected personal information that you are requesting to be deleted.

(3) Right to Opt-Out of the Sale of Personal Information

You have the right to opt-out of the sale of your personal information by a business. Pursuant to California law, because we do not and will not sell your personal information, we do not offer such an opt-out at this time.

(4) Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

You have the right not to receive discriminatory treatment by the business for the exercise of the privacy rights conferred by the California Consumer Privacy Act.

(5) Authorized Agent

If you would like to make a request under the California Consumer Privacy Act on behalf of a California consumer who is a current or former customer, please provide an email from the email address we have on file for the customer authorizing the request.

You may also make a request under the California Consumer Privacy Act on behalf of a California consumer if you provide (1) a signed, written permission from the consumer to act on your behalf, and the consumer verifies their own identity directly with us; or (2) proof that the consumer has provided you with power of attorney pursuant to Probate Code sections 4000 to 4465

We may deny a request from an agent that does not submit proof that they have been authorized by the consumer to act on their behalf.
